Where is The Berkley and how big is it?
It is at 177 Vo Nguyen Giap, An Khanh Ward, HCMC (Thao Dien, Thu Duc City), about 300m from An Phu Metro station measured from the site boundary (per the developer file). Scale: one 21-storey building (tower on levels 3–21, podium on levels 1–2) plus one basement, 85 apartments in total, on a 10,943.7 sqm site. The show unit is on the 18th floor of the building itself.
What unit types and sizes are available?
Per the developer file: 1-bedroom, 2 units (106.24 sqm); 2-bedroom, 66 units (81.17–141.70 sqm); 3-bedroom+1, 15 units (176.78 sqm). Fifty units have balconies and two units have a private garden (PES) for the owner's exclusive use. Final areas will be confirmed by a surveyor; PES areas are indicative only.
As a foreigner, what contract do I sign — and do I get a title?
This is the single most important point to understand. Per the developer file, the business model is long-term lease first, then a sale contract later. Foreign individuals and entities sign only (i) a booking form and (ii) a Long-Term Lease Agreement (LTLA) — the file does not list an asset-transfer step for this group. Vietnamese buyers sign a booking and an LTLA, and only sign an Asset Transfer Agreement (ATA) once the developer notifies that the project/unit is eligible for sale, the ATA is approved by the competent authority and the buyer qualifies. On tenure, the developer answers that, based on similar cases in HCMC that have been granted certificates, this type of property has a long-term land use term and an indefinite ownership term for the building — that is a reference to comparable cases, not a commitment for your specific unit. Take independent legal advice and get written confirmation before paying anything.
Who operates the building, and what are the running costs?
The operator is Highgate, which also manages Serenity Sky Villas and The Metropole Thu Thiem (The Crest, The Galleria, The Opera). Per the developer file: the proposed management fee is VND 46,000 per sqm of usable area per month (excluding VAT); parking is currently VND 200,000/month per motorbike and VND 2,200,000/month per car. Note that the whole building has only 23 car parking spaces and 92 motorbike spaces in one basement — if you drive, confirm a space in writing before committing. Electricity, water and internet are charged on actual usage.
Can the apartments be used for short-term rental, and what yield can I expect?
Per the developer file, apartments at The Berkley are permitted to be used for short-term accommodation, and a legal entity running such a business may register the apartment as its business address. The customer signs a long-term lease with the developer and may sublease in line with that lease and Vietnamese law; the developer advises consulting a lawyer for subleasing. On returns, the project website cites 6–17% per year for short-term operation — that figure is published by the seller and is a projection, not a guarantee. It depends on your price, occupancy, operating costs and the short-stay rules in force. Model it yourself and ask for the operating agreement in writing.
Is there a bank guarantee, and which bank supports financing?
Per the developer, the bank-guarantee requirement exists for off-plan (future-formed) housing to ensure delivery; because The Berkley was completed before the transaction, that requirement does not apply. For financing, the developer is working with Vietnam International Bank (VIB) on support programmes, and VIB is also the preferred bank if you mortgage during the lease term.
How does the maintenance (sinking) fund work?
Per the developer file: Vietnamese customers have no maintenance fee during the long-term lease period (until Q4 2027); foreign individuals and entities (lease contract only) pay 2% of the lease contract price. For units with a PES (private exclusive-use) area, an additional maintenance contribution applies to that PES area.
What is the payment schedule?
Per the developer's official sales policy dated 18/06/2026: a VND 200 million deposit on signing the Placement Confirmation; Instalment 1 (5%, deposit included) on signing the Long-Term Lease contract within 14 days; Instalment 2 (5%) two months later; Instalment 3 (10%); Instalment 4 (10%) at apartment handover; Instalments 5–9 at 10% each, two months apart; Instalment 10 (20%) — cumulatively about 75% of the sale-contract (SPA) price. Vietnamese buyers then have Instalment 11 on the SPA-signing notice (~26.6%, expected Q4/2027) plus the sinking fund (~2.7%), and Instalment 12 on the pink book (~6.7%, expected Q2/2028) — about 25% of the SPA price. For foreign customers the schedule ends at Instalment 10, i.e. 100% of the long-term lease value. Figures are per the developer file at the time of update and may change.
What promotions are offered?
Per the developer's sales policy dated 18/06/2026: (1) a 4% discount on the total price for all customers, applicable if the 1st instalment is paid on time; (2) 24 months of management fees free (not convertible to cash); (3) buyers who pay on schedule are placed on a priority list for early unit selection at SonKim Land's next key project (for example the Thu Thiem Station Urban Complex), subject to the developer's official policy at the time. Confirm with Happy Land that the promotion is still valid.
What is included in the handover, and which brands?
Per the official handover specification dated 30/03/2026: porcelain tile floors in the living/dining and kitchen, engineered wood in bedrooms; painted gypsum ceilings; aluminium-framed double-glazed tempered/heat-strengthened glazing; fire-rated timber entrance door with digital lock; kitchen with wall and base cabinets, solid-surface/natural-stone countertop, stainless-steel sink, electric hob, cooker hood and oven; built-in wardrobes and entrance cabinet; Daikin VRV air-conditioning; Kohler sanitary ware (bath tub in 2BR and 3BR units where applicable); electric water heaters; video door intercom. The quotation lists the handover standard as 'semi furnished' — meaning fixtures and appliances are complete while loose furniture may not be included. Check the handover list for your specific unit before signing.
Is the placement/booking deposit refundable?
Per the official Placement Confirmation template (marked 'non-refundable'), the booking fee is NOT refundable if the customer fails to complete Instalment 1 and sign the Long-Term Lease Agreement within the deadline stated on the form (typically counted in days from the signing date). If the deadline is missed, the developer may treat the customer as having abandoned the placement, terminate the confirmation, and resell the unit to another party without any refund or compensation. The Placement Confirmation also cannot be assigned to a third party. Make sure you are certain about the unit, price and your financing before paying the deposit, and confirm the exact deadline with Happy Land.
